With the name "Law of cookies" is known as the third point of article 4 of Royal Decree-law 13/2012, of March 30 that was published in the "Official State Gazette" on Saturday March 31 2012 and came into force the next day. The Law on cookies, transposition of Directive 2009/136 / CE, of the European Parliament and of the Council, of November 25, 2009, is integrated into the LSSI (Law 34/2002, of July 11, on services of the company of information and electronic commerce) modifying the second point of article 22, which is drafted as follows:
Article 22.2 of Law 34/2002. Banking service providers may use data storage and retrieval devices in terminal equipment of the recipients, in particular, on the same fines for data processing, in accordance with the provisions of Organic Law 15/1999, of 13 December, Protection of Personal Data.
When technically possible and effective, the consent of the recipient to accept the processing of the data can be facilitated by using the appropriate parameters of the browser or other applications, provided that this is a procedure for its installation or update by an action. Express for that purpose.
The foregoing shall not prevent the possible storage or access of a technical nature for the sole purpose of the transmission of a communication by an electronic communications network or, insofar as is strictly necessary, for the provision of a service of the information society expressly requested by the recipient.
